1. Agreement to Terms
By booking a tour, renting a motorcycle, or using any services provided by Nepal Moto Tours ("Company", "we", "us"), you ("Client", "Traveler", "Rider") confirm that you have read, understood, and agreed to these Terms of Service.
These Terms apply to all services including:
- Guided motorcycle tours
- Self-guided tours
- Motorcycle rentals
- Custom travel packages
2. Booking & Payment
2.1 Booking Process
To confirm your booking:
- Submit the booking form or inquiry
- Receive confirmation from our team
- Pay the required deposit
2.2 Deposit
- A non-refundable deposit is required to secure your booking
- Booking is not confirmed until deposit is received
2.3 Final Payment
- Full payment must be made 30–60 days before trip start date
- Failure to pay may result in cancellation and loss of deposit
2.4 Pricing
- Prices are listed in USD unless stated otherwise
- Prices may change due to:
- Fuel costs
- Government permit changes
- Currency fluctuations
3. Cancellation & Refund Policy
3.1 By Client
- 60+ days before trip: Refund minus deposit
- 60–30 days: 50% refund
- <30 days: No refund
3.2 No Shows / Early Exit
No refunds for:
- Late arrival
- Leaving tour early
- Missed activities
4. Rescheduling Policy
Requests made 60+ days before trip may transfer payments to a future trip (within 12 months). Price differences may apply.
5. Force Majeure
We are not liable for cancellations or changes due to events beyond our control, including:
- Natural disasters
- Landslides / road closures
- Political unrest
- Pandemics
- Government restrictions
In such cases:
- We may offer trip credit or rescheduling
- Refunds may exclude incurred costs
6. Travel Insurance (Mandatory)
All clients must have valid travel insurance, covering:
- Medical emergencies
- Motorcycle riding (high-risk activity)
- Emergency evacuation (helicopter rescue)
Failure to provide proof may result in cancellation without refund.
7. Entry Requirements (Nepal)
Clients are responsible for:
- Valid passport (minimum 6 months validity)
- Nepal visa (If required by law)
- Required permits and documentation
We are not liable for denied entry or travel disruptions.
8. Rider Requirements
To ride a motorcycle:
- Minimum age: 18 years
- Valid motorcycle license
- International Driving Permit (IDP)
- Prior riding experience (recommended minimum 1 year)
We reserve the right to:
- Deny riding access if skill level is unsafe
- Assign alternative transport (support vehicle)
9. Motorcycle Usage & Damage
Riders are responsible for:
- Motorcycle damage
- Third-party damage
- Minor wear & tear is acceptable
- Major damages must be paid by the rider
- A security deposit may apply for rentals
10. Health & Fitness
Clients must:
- Be in good physical condition
- Disclose any medical conditions
We reserve the right to remove any participant if:
- Safety is at risk
- Health condition becomes critical
No refunds will apply.
11. Safety & Conduct
- No riding under the influence of alcohol or drugs
- Follow guide instructions at all times
- Respect local laws, culture, and environment
We reserve the right to remove any participant for:
- Unsafe behavior
- Misconduct
12. Itinerary Changes
Travel in Nepal is unpredictable. We may modify itineraries due to:
- Weather
- Road conditions
- Mechanical issues
- Safety concerns
We will always aim to provide the best alternative experience.
13. Assumption of Risk
Motorcycle travel in Nepal involves inherent risks including:
- Road hazards
- Altitude sickness
- Accidents
By booking, you acknowledge and accept these risks and agree that:
- Nepal Moto Tours is not liable for injury, loss, or damages
- Participation is at your own risk
14. Emergency & Medical Consent
You authorize our team to:
- Arrange emergency medical treatment
- Coordinate evacuation if necessary
All costs are the responsibility of the client or their insurance provider.
15. Photography & Media
We may use photos/videos taken during tours for:
- Marketing
- Social media
- Website
If you wish to opt out, notify us in writing.
16. Liability Limitation
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages
- Our responsibility is limited to the cost of the booked service
17. Governing Law
These Terms are governed by the laws of Nepal. Any disputes shall be handled under the jurisdiction of Nepal courts.
18. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services means acceptance of updated terms.
